Overview

The Head of Compliance role plays a key leadership role maintaining high standards across the LFSL business, while constantly looking for new ways to improve efficiencies and performance.

The role holder will attend the LFSL Boards as required (including their committees) and may be a member of and/or may chair such LFSL Board Committees as may be necessary from time to time.

Key Accountabilities and Main Responsibilities

Management, leadership and direction of LFSL' Compliance function.

Performing the Compliance Oversight Role as defined in SUP 10C.6.1R, including responsibility for:

Compliance resourcing.

The delivery of an appropriate risk-based monitoring programme.

The tracking and communication of regulatory developments.

The reporting, assessment and resolution of breaches.

The provision of advice on compliance matters.

Ensuring the timely and complete filing of regulatory returns.

As Compliance Officer:

To act as SMF16 with FCA for the regulated entiy Link Fund Solutions Limited.Provide assurance and advice on regulatory risks to the Global CEO, MDs and other senior management in LFSL, and the Global Head of Risk and Compliance Fund Solutions..

Ensure that effective advice is provided on compliance matters and regulatory change and that relevant compliance policy and controls are created, managed and communicated effectively.

Ensure that all fund documentation including prospectuses are kept up to date with regulatory changes

Ensure that there is an appropriate risk-based compliance monitoring programme in place for the above regulated entities ensuring timely delivery of the programme and that it is designed to assess all regulated activities with appropriate frequency.

Ensure that regulatory developments are tracked appropriately, and their relevance and impact are communicated to the business. Compliance is to act as SME on any regulatory change project.

Ensure that all incidents and breaches are reported, assessed and issues identified are effectively addressed, ensuring that compensation, where required, is paid as appropriate and effective remedial action is taken to prevent recurrence.

Ensure the Compliance Function in LFSL has sufficient resources and that it is appropriately structured.

Liaison with the FCA and Depositaries as required.

Define, manage and deliver Compliance reporting to LFSLs ' governance committees on a timely basis.

Attendance at key governance and control meetings.

Support business initiatives as appropriate e.g. acquisitions

Keep LFS Global Head of Risk and Compliance and LFSL Directors informed of relevant regulatory matters.

Overarching responsibility for ensuring Compliance meets its plans and performance targets.

Mitigate operational risk pertinent to the Compliance function through relevant risk assessment procedures, adhering to policy and in accordance with risk management frameworks.

Effective monitoring and oversight of risk frameworks relating to Compliance ensuring these are embedded.

Oversight of compliance with all regulatory reporting whether or not undertaken by Compliance.

Oversight of the complaints-handling process for LFSL.

As a Fund Solutions senior staff member:

Represent the business at a senior level.

Maintains knowledge of technical and business knowledge, industry and business developments, and regulatory requirements.

Contribute to compliance discussions within the Fund Solutions business and where appropriate liaise with other Heads of Compliance in the business, especially EMEA

Ensure that an up to date succession and talent plan in place.

Support the growth, embedding and sustaining of a strong culture across the Fund Solutions business, one which instils accountability and strong engaging behaviours (e.g. no fear of speaking up).

Experience & Personal Attributes

Minimum of a university degree.

A superior networker, negotiator, and business leader.

Knowledge and experience within a regulatory environment, including a sound understanding of the Senior Managers and Certification Regime.

Previously approved by the FCA as an SMF 16 within an Asset /Investment Management, ACD, Asset Servicing or Depositary Environment

Significant experience of leading teams and providing strategic direction across multiple locations.

Solid experience of setting and achieving business targets, time lines, plans and financial targets.

High quality communication and presentation dexterity.

Deep understanding and working knowledge of Financial regulations.

Proven track record in managing a large department or function.

Significant experience of managing change and transition activity.

Be able to demonstrate an adequate degree of commercial acumen.

Personal commitment to and visible role modelling of the organisation's behaviours and values. This will include in depth experience in the development and embedding of a strong culture, one which adheres to FCA conduct rules and embeds positive behaviours & values.

Relevant experience working in a regulated financial service business, preferably in investment management.

Good / broad understanding of the markets in which we operate.

Thorough knowledge of market changes and forces that influence the company.
